This was quickly followed by July decisions in Moody v. NetChoice and NetChoice v. Paxton, in which the Supreme Court ruled, unanimously, to vacate and remand the decisions by the Eleventh and Fifth Circuit Courts, indicating skepticism over Texas’ and Florida’s laws attempting to regulate social media moderation.

Tech Policy Forecast:

Overall, we expect most of the action to unfold in the states on topics ranging from AI to kids’ online safety and age verification. At the federal level, the privacy stalemate will likely remain as lawmakers focus on global competition and AI risks.

The EU’s tech regulation, the Digital Markets Act, will continue to have its impacts felt around the world, with regulators in other jurisdictions watching closely. Get ready for the deluge!
